OOH Advertising Photography Terms & Conditions

Effective from: 25 August 2026

These OOH Advertising Photography Terms & Conditions apply to out-of-home advertising photography, including billboards, digital displays, transport advertising, street furniture, posters, murals, experiential installations and other advertising displays photographed by Philipp Ammon Photography (“the Photographer”).

These terms should be read together with the Photographer’s General Terms & Conditions and the quotation or booking confirmation applicable to the assignment.

Where there is a conflict, terms expressly agreed in writing for a particular assignment will take precedence.

1. Booking and Scope

The locations, expected photography time, campaign or brand, approximate number of sites and other requirements will be set out in the applicable quotation, brief or booking confirmation.

Quotations are based on the information supplied by the Client at the time of quotation, including site locations, number and type of displays, number of creatives, digital rotation information, required angles and any other known requirements.

Unless otherwise agreed, pricing assumes photography of the campaign, brand, creatives and locations specified in the original brief.

Material changes or additions to the brief may require a revised fee.

2. Cancellation

Cancellation of a confirmed assignment must be communicated to the Photographer in writing.

Where the Client cancels an assignment, or any individual date forming part of a multi-date booking, the Photographer reserves the right to charge the following cancellation fees:

  • More than 14 days before the assignment: no cancellation fee, except for any non-refundable expenses or work already undertaken.

  • Between 7 and 14 days before the assignment: up to 50% of the photography fee attributable to the cancelled assignment or date.

  • Less than 7 days before the assignment: up to 100% of the photography fee attributable to the cancelled assignment or date.

Any non-refundable expenses, third-party costs or work already undertaken specifically for the assignment may also remain payable.

The Photographer may waive or reduce a cancellation charge at his discretion where circumstances reasonably justify doing so.

3. Postponement and Rescheduling

The Photographer recognises that OOH campaign schedules may change as a result of installation dates, media-owner schedules, weather, campaign availability and other operational circumstances.

Where the Client requests postponement before photography has commenced, the Photographer will normally endeavour to transfer the assignment to a suitable replacement date without additional charge, subject to availability.

Where an assignment is postponed after the Photographer has commenced travel, arrived at a location, begun photography, incurred non-refundable expenses or otherwise undertaken substantial work specifically for the assignment, the Photographer reserves the right to charge for the time, work and expenses already incurred.

Where the Client and Photographer agree before travel that weather or other environmental conditions make photography impracticable or unlikely to produce reasonable results, the assignment may normally be rescheduled without additional charge, subject to availability.

Where photography proceeds at the Client’s request despite known adverse conditions, work undertaken remains chargeable even where the Client subsequently requests additional photography in improved conditions.

If the Photographer attends a site and the advertising is absent, unavailable, not displaying or otherwise cannot be photographed for reasons outside the Photographer’s reasonable control, this will be dealt with under the provisions relating to Display Failure, Missing Advertising and Unsuccessful Sites rather than being treated as a postponement.

Any replacement date is subject to the Photographer’s availability, and a substantial change to the scope, locations or requirements of the assignment may require a revised quotation.

4. Site Numbers and Scheduling

Any number of sites proposed for a half-day, full-day or other time period is an estimate based on the information available at the time of quotation.

The number of sites that can reasonably be photographed depends on factors including travel time, traffic, parking, access, site type, pedestrian and vehicle activity, weather, available viewpoints, digital display frequency, creative rotation and the amount of photography required at each location.

The Photographer will use reasonable efforts to cover the agreed locations within the available photography period but does not guarantee that a particular number of sites can be completed unless expressly agreed in writing.

Where circumstances mean that fewer sites can reasonably be photographed within the booked period, additional photography time or an additional assignment may be required to complete the remaining locations.

5. Creatives and Digital Displays

Unless otherwise stated in the quotation, OOH photography pricing assumes a reasonable number of creative variations at each site.

Where a site contains multiple creatives, multiple brands, unusually long digital loops, infrequent display intervals or other requirements that materially increase the time needed to photograph the site, additional photography time or fees may apply.

Capturing every creative variation is not guaranteed unless this has been specifically included in the agreed brief.

Digital advertising displays are controlled by third-party operators. The Photographer cannot guarantee the frequency, duration, sequence, brightness, functionality or availability of a particular creative.

The Photographer will use reasonable professional judgement to obtain suitable photographs during the time available.

6. Angles and Compositions

The Photographer retains professional discretion over the number and type of photographs, viewpoints, focal lengths, compositions and angles produced at each site.

Where the Client requests particular angles, environmental context, traffic, pedestrians, landmarks or other compositional elements, the Photographer will make reasonable efforts to accommodate these requirements where conditions allow.

Any quantities of photographs or angles discussed in advance are estimates unless expressly guaranteed in writing.

7. Site Information and Client Responsibilities

The Client is responsible for providing reasonably accurate and complete site information, including addresses, location references, display formats and any other information necessary to identify the advertising installation.

Where available, the Client should also provide relevant campaign dates, creative information, digital rotation details, access instructions and site reference photographs.

The Photographer will not be responsible for delays, unsuccessful photography or additional time resulting from materially incorrect, incomplete or outdated information supplied by the Client or a third party.

Additional time, travel or revisits required because of incorrect or incomplete site information may be charged separately.

8. Access and Permissions

The Client is responsible for arranging any permissions, accreditation or access required to photograph locations that are not freely accessible to the public.

The Photographer will comply with reasonable instructions from site owners, transport operators, security personnel, police, local authorities or other authorised parties.

Where photography is restricted, prevented or materially limited by a site owner, operator, security personnel or another third party, the Photographer will not be responsible for photographs that cannot reasonably be obtained.

Any additional visit required as a result may be chargeable.

9. Display Failure, Missing Advertising and Unsuccessful Sites

The Photographer is commissioned to attend and photograph the advertising sites specified in the agreed brief. The Photographer does not control the installation, operation, scheduling or maintenance of the advertising displays themselves.

Where the Photographer attends the correct location within the agreed campaign period but the advertising cannot reasonably be photographed because, for example:

  • the advertisement is not displaying;

  • the creative is absent from the digital rotation;

  • the display is switched off or malfunctioning;

  • the installation has been removed, covered, damaged or obstructed;

  • the campaign has been installed late or removed early;

  • the site is temporarily inaccessible;

  • construction, vehicles or other unexpected obstructions prevent a reasonable photograph; or

  • another circumstance outside the Photographer’s reasonable control prevents successful photography,

the Photographer’s attendance, travel and time remain part of the commissioned assignment and are chargeable.

The Photographer will make reasonable efforts to notify the Client of significant issues encountered during the assignment where practicable.

Any requested revisit to an unsuccessful site will normally be treated as additional work and may incur additional photography, travel and expense charges unless the need for the revisit resulted directly from the Photographer’s failure to carry out the agreed services with reasonable skill and care.

10. Weather and Environmental Conditions

OOH photography is inherently affected by weather, daylight, traffic, pedestrian activity, construction, temporary obstructions and other environmental conditions.

The Photographer will use professional judgement to obtain the best reasonable results in the conditions encountered.

Unless particular weather, lighting or environmental conditions have been expressly agreed as a requirement of the assignment, unsuitable or changing conditions do not automatically constitute a failure to provide the agreed services.

Where the Client requests postponement, rescheduling or a revisit because of weather or environmental conditions, additional fees and expenses may apply, subject to the provisions relating to postponement and rescheduling above.

Where weather conditions present an unreasonable safety risk or make photography impracticable, the Photographer may suspend or reschedule the affected part of the assignment.

11. Travel, Routes and Timing

Where an assignment involves multiple locations, the Photographer will determine a reasonable route and shooting order based on the brief, geography, expected conditions and professional judgement.

Travel between sites forms part of the time required to complete an assignment unless otherwise stated in the quotation.

Journey times and site schedules are estimates and may be affected by traffic, road closures, public transport disruption, parking, access restrictions or other circumstances outside the Photographer’s control.

Where substantial additional travel is introduced through changes to the brief or the addition of locations, the fee may be revised accordingly.

12. Changes and Additional Sites

The quotation applies to the scope supplied at the time of booking.

Additional sites, brands, creatives, formats, deliverables, photography requirements or geographical areas requested after quotation may result in additional fees or require additional photography time.

Where reasonably practicable, the Photographer will advise the Client of material additional charges before undertaking substantially expanded work.

Where requirements are materially reduced before the assignment, the Photographer may reduce the final fee where appropriate, subject to any applicable minimum booking or cancellation provisions.

13. Editing and Retouching

Unless otherwise stated, standard OOH photography includes the Photographer’s normal image selection and general adjustments to colour, exposure, contrast, perspective, cropping and other routine photographic corrections.

Advanced retouching is not included unless specifically stated in the quotation.

Advanced retouching may include, without limitation, substantial glare or reflection removal, object or person removal, replacement or reconstruction of advertising copy, compositing, extensive plate or face blurring, significant perspective reconstruction or other detailed image manipulation.

Where requested or necessary, advanced retouching may be quoted or charged separately.

Some visual artefacts associated with photographing digital displays, including moiré, banding, refresh patterns, colour variation or other screen-related effects, may not be completely removable in post-production. The Photographer will use reasonable professional techniques to minimise these effects but cannot guarantee their complete elimination.

14. Client-Supplied Photographs and Editing-Only Work

Where the Photographer is commissioned to edit photographs or RAW files captured by the Client or another photographer, the quality and scope of the final result will depend upon the source material supplied.

The Photographer is not responsible for technical limitations present in supplied files, including focus, motion blur, resolution, exposure, compression, moiré, banding, reflections, perspective, framing or other capture-related issues.

The Photographer will use reasonable professional judgement when editing supplied material but cannot guarantee that all defects or unwanted elements can be corrected.

Any extensive reconstruction, compositing or other advanced retouching required beyond the agreed editing scope may incur additional fees.

The Client warrants that it has the necessary copyright, licences and permissions to provide the supplied material to the Photographer for editing.

15. Image Delivery

Unless otherwise stated in the quotation, the Client will receive an edited selection of high-resolution JPEG photographs.

The number of photographs delivered will depend on the number and type of sites, creatives, conditions and scope of the assignment. Any quantities discussed in advance are approximate unless expressly guaranteed in writing.

The Photographer selects the final photographs in accordance with his professional judgement.

Delivery times stated in quotations are estimates unless expressly guaranteed. Same-day, next-day or other expedited delivery may be available by prior agreement and may incur an additional fee.

16. OOH Photography Licence

Unless otherwise stated in the quotation or agreed in writing, delivered photographs are licensed to the commissioning Client for use in connection with the campaign and brand or brands specified in the agreed brief.

Permitted use includes the Client’s internal reporting, campaign documentation, case studies, presentations, PR, website, organic social media, awards submissions and other reasonable promotional use relating to the commissioned campaign.

Copyright remains with the Photographer in accordance with the General Terms & Conditions.

The standard licence does not automatically permit use of the photographs for unrelated campaigns, unrelated brands, resale, stock-library distribution, merchandising or transfer of usage rights to unrelated third parties.

Where the commissioning Client is an agency, media owner or other intermediary acting on behalf of a named end client or brand, the agreed licence may include reasonable use by that named end client or brand in connection with the commissioned campaign.

Use by additional brands, clients, agencies or other parties not included within the original brief may require an additional licence and fee.

17. Multiple Brands and Campaigns

Unless otherwise agreed, quotations are based on the brand, campaign or campaigns identified in the original brief.

Where an assignment involves multiple unrelated brands or campaigns, additional photography and/or licensing fees may apply to reflect the increased commercial use and scope of the assignment.

The Client should identify all brands, advertisers or end clients requiring use of the photographs when requesting a quotation.

Where additional brands or clients are introduced after quotation or following delivery, the Photographer reserves the right to agree an appropriate additional licence and fee before such use takes place.

18. Video and Additional Media

Unless expressly included in the quotation, an OOH photography assignment covers still photography only.

Any video clips captured voluntarily by the Photographer during an assignment do not create an obligation to provide video coverage, editing, colour grading or other video services.

Where the Client requests video capture, editing, grading or other additional media services, these may be quoted or charged separately.

19. Application of General Terms

All other matters, including payment, copyright ownership, licensing conditions, RAW files, AI use and alteration, expenses, confidentiality, portfolio use, storage and archiving, liability, safety, circumstances beyond the Photographer’s control and governing law are subject to the Photographer’s General Terms & Conditions unless expressly varied by these OOH Advertising Photography Terms or by written agreement for the assignment.
